About Us
Karnival-House is part of Cavalcade; a family business with over 20 years experience of having fun. The following Terms and Conditions cover the sale of goods from Karnival-House and do not affect your statutory rights as a consumer.
1. Definitions
1.1 ‘Karnival-House’ means Cavalcade of Carnival House, Ambleside Gardens, Hullbridge, Essex SS5 6ES.
1.2 The ‘Customer’ means the person who buys or agrees to buy goods from Cavalcade/Karnival-House.
1.3 ‘Goods’ means the fancy dress costumes or related accessories and party products supplied in accordance with these Terms and Conditions.
2. Prices
2.1 The price of the Goods shall be that specified on the Cavalcade/Karnival-House website and confirmed within the order e-mail confirmation.
2.2 All prices specified on the website are inclusive of VAT. On your basket of goods, you will be shown prices exclusive of VAT which is calculated and added to your order during check out prior to the Customer confirming the order.
2.3 Delivery charges will be displayed in the shopping cart prior to the Customer confirming the order.
2.4 Free Postage Offer is applied to basket prices inclusive of VAT but prior to application of postage. The value of the goods must be over the level specified.
3. Contract
3.1 Cavalcade/Karnival-House will send the Customer an e-mail confirming that an order has been received. This e-mail does not indicate that a contract exists between Cavalcade/Karnival-House and the Customer. This contract will exist at the point of dispatch of the goods constituting the Customer's order. This has been included to protect Cavalcade/Karnival-House in the case that a genuine mistake has been made in pricing. If goods have inadvertently been under-priced, or Cavalcade/Karnival-House unable to supply particular goods for some reason. In the case of a change of price, the Customer will be notified to ensure that the new price is acceptable or given the opportunity to cancel the order and receive a full refund.
4. Payment
4.1 Cavalcade/Karnival-House will debit the Customers credit/debit card with payment in full for the Goods and delivery charges on or after the date of the Customers order.
4.2 If payment is declined by the issuer of the Customers credit or debit card, Cavalcade/Karnival-House will contact the Customer to establish an alternative means of payment before authorising the dispatch of the ordered Goods.
4.3 Secure Shopping; Cavalcade/Karnival-House online ordering service is hosted on a secure-server, so you can be confident that when you send your details they will be held in a safe environment. Once our order has been processed payment details are permanently removed from the website.
5. Delivery
5.1 The Goods will be delivered by a nominated courier to the address specified by the Customer and which will be detailed in the order e-mail confirmation.
5.2 Customer orders are usually delivered within 3-7 working days from acceptance of the order unless otherwise notified by Cavalcade/Karnival-House. Cavalcade/Karnival-House will not be liable for any delay in delivery. If goods are failed to be dispatch within 30 days of accepting the Customer's order (or longer if previously notified), Cavalcade/Karnival-House will refund, in full, payment made in respect of such Goods.
5.3 If the Customer fails to take delivery of the Goods at the address specified in the order confirmation e-mail, or fails to provide Cavalcade/Karnival-House with adequate delivery instructions, then the Goods will be returned to Cavalcade/Karnival-House and the Customer advised. In these instances, Cavalcade/Karnival-House will charge the Customer for redelivery of the Goods.
5.4 Should any items be temporarily out of stock, Cavalcade/Karnival-House will notify the Customer immediately and advise the estimated date of next available stock. The Customer will have the option to leave the item on back order, select an alternative product or cancel the order.
5.5 Cavalcade/Karnival-House does not accept any responsibility for late receipts of Goods due to delays from manufacturers, shipping agencies or any other factor outside of our control.
6. Ownership and Risk
6.1 The risk of loss or damage to the Goods shall pass to the Customer upon dispatch of those Goods from Cavalcade/Karnival-House's premises for delivery to the Customer at the address specified in the order confirmation e-mail.
6.2 Cavalcade/Karnival-House remains the owner of the Goods until the Customer has paid in full for such Goods.
6.3 The Customer shall inspect the Goods immediately upon receipt and shall notify Cavalcade/Karnival-House within 48 hours of delivery if the Goods are damaged or do not comply with the details presented in the order confirmation e-mail. If the Customer fails to do this, they will be deemed to have accepted the Goods.
6.4 Any Goods in respect of which a claim for defect or damage is made shall be preserved by the Customer at the Customers risk and retained for a reasonable period to enable Cavalcade/Karnival-House to inspect the Goods or request return.
7. Returns
7.1 Exchange:- Cavalcade/Karnival-House will only accept items in their original packaging with labels intact and in general good condition for exchange. Items can be exchanged for a comparable garment, with a change of size or colour. An exchange fee of £2.50 charge will be applied to cover our carriage and administrative expenses.
7.2 Returns: Cavalcade/Karnival-House offers its Customers the right to return unwanted Goods within 7 days after delivery. Cavalcade/Karnival-House will only accept items in their original packaging with labels intact and in general good condition for refund. Goods that have been properly supplied and accepted for refund will incur a restocking charge of the lesser of 15% of the original price or £6 which will be deducted from the refund.
7.3 Cavalcade/Karnival-House aims to make all refunds within 30 days of agreement.
7.4 Cavalcade/Karnival-House cannot accept any responsibility for loss or damage to Goods while in transit from our premises to the Customer, nor whilst they are in transit from the Customer to us. We suggest all returns are made using recorded or special delivery.
7.4 In respect of Goods that have been returned due to a claim of defect or damage, should the claim be accepted by Cavalcade/Karnival-House, the Customer will be offered Goods in exchange or a full refund. Should the claim be found to be unfounded, the Customer will be offered a refund minus any reasonable costs incurred by Cavalcade/Karnival-House.
8. Privacy
8.1 Cavalcade/Karnival-House does not disclose Customers information to third parties other than when order details are processed as part of the order fulfillment. In this case, the third party will not disclose any of the details to any other third party.
8.2 Cookies are used on this website to keep track of the contents of your shopping cart. They are also used after you have logged on as part of that process. You can turn off cookies within your browser by going to 'Tools | Internet Options | Privacy' and selecting to block cookies. If you turn off cookies, you will be unable to place orders or benefit from the other features that use cookies.
9. General Terms
9.1 Every effort has been made by Cavalcade to ensure that no error or omission has been made in any website text, price list, order confirmation e-mail, or other document, information or advice given by employees of Cavalcade/Karnival-House. In this respect, correction shall be without any liability on the part of Cavalcade.
9.2 In the event that Cavalcade/Karnival-House is prevented from carrying out its obligations under a contract of sale as a result of any cause beyond its control such as, but not limited to, Acts of God, War, Strikes, Lock-outs, Flood and Failure of third parties to deliver goods, then Cavalcade shall be relieved of its obligations and liabilities under such contract of sale as long as such fulfillment is prevented.
9.3 Except as may be implied by law where the Customer is dealing as a consumer, in the event of any breach of these Terms and Conditions by Cavalcade/Karnival-House the remedies of the Customer shall be limited to damages which shall in no circumstances exceed the price of the Goods and Cavalcade/Karnival-House shall under no circumstances be liable for any direct, incidental or consequential damage.
9.4 The laws of England shall govern the contract between Cavalcade/Karnival-House and the Customer.
9.5 If any part of these Terms and Conditions that is fundamental is found to be illegal or unenforceable, such findings will not affect the validity or enforceability of the remainder of these Terms and Conditions.
